Prohibition of the threat or use of force.


I will begin with discussing the principle of prohibition of the threat or use of force. I would like to present the most essential aspects of this principle and to shortly analyse some situations with regard to prohibition of use of force.

This brings to 3 main ideas of the article: Application scope, the objects and the content of the term “force”.

To begin with, it is important to tell that this principle only applies to cross-border relations, this means that it is not applicable in state’s domestic relations. For instance, if there is a rebellion in a particular country, the government may use a force and it will not be internationally wrongful act.

The objects that are secured under this article are territorial integrity, political independence, purposes of UN.

The threat of the use of force is unlawful where the use of force itself would be unlawful in those circumstances.

It may seem now that this principle is unambiguous. However, the Charter itself in some occasions authorises to use force. That I mean is that sometimes use of force can be legitimate.
