Probably the major source of problems during trial is the process of determining whether or not the accused party is guilty, and not the sentence itself. That is due to two things: first off, lots of cases are very subjective and leave lots of room for discussing and come down to the final decision of a judge. Secondly, there are major loopholes in the laws themselves, which often result in miscarriages of justice since the actions required to take to prove the opposing party guilty would be illegal.
